Jahrhundert sieht sich das Recht neuen Anforderungen ausgesetzt, für welche seine bisherigen Regulierungsmechanismen kaum noch ausreichen; es lässt sich eine sogenannte Steuerungskrise beobachten. Verschiedene Lösungsansätze werden vorgeschlagen, um diese Krise zu bewältigen, unter welchen derjenige der Prozeduralisierung eine besondere Erwähnung verdient.
